Crypto Tax in Turkey 2026 | Legal Framework and Reporting
Law No. 7518 brought crypto-asset service providers within Turkey’s capital-markets framework. It did not create a 0.03% tax on every crypto sale or automatic withholding on investors’ gains. A 2026 proposal for a crypto transaction tax appeared in Bill No. 2/3560, but the enacted text of Law No. 7577 did not include that measure. Whether a particular gain, payment or business activity has tax consequences requires an assessment of the transaction and the applicable tax law. This guide explains the distinction for investors and businesses.
Does Law No. 7518 Impose a Crypto Transaction Levy?
No. Law No. 7518 regulates crypto-asset service providers under the Capital Markets Law. It did not extend Banking and Insurance Transactions Tax (BSMV) to every crypto sale at a 0.03% rate. Law No. 7524 likewise did not create a general 0.03% crypto transaction charge. A trading fee shown by an exchange should be checked against its fee schedule; it should not automatically be described as a statutory tax.
What Happened to the 2026 Tax Proposal?
Bill No. 2/3560 proposed a transaction tax on certain crypto sales and transfers. The proposal and the law enacted after parliamentary deliberation are different documents. The crypto transaction tax provision was omitted from the enacted text of Law No. 7577. Readers should check the current enacted law before treating a bill, press report or exchange notice as an operative tax rule.
Are Personal Crypto Gains Exempt from Income Tax?
Law No. 7518 does not establish a blanket exemption for individuals. Nor does it classify every personal crypto transaction as taxable under one income category. Tax residence, the nature and regularity of activity, the source of a payment and the relevant income-tax provisions matter. Frequent or organised trading, staking, mining and other activities may raise different questions. A conclusion about filing or payment requires the facts and the law applicable to that taxpayer.
Companies and Crypto-Asset Service Providers
A company holding or trading crypto assets should assess its accounting records, tax base, income and deductible costs under the rules applicable to that company and activity. A service provider must separately assess capital-markets, anti-money-laundering, documentation and tax duties. Provider status alone does not mean that it must withhold tax on every customer’s trade or file a particular withholding return for each sale.
Staking, Mining, Airdrops and DeFi
These activities can differ in economic substance and legal structure. An automatic tax rate or a universal income category should not be assumed. Keep dated records of acquisitions, transfers, rewards, fees, disposals, wallet addresses and platform statements. The records support an individual assessment of the activity and any reporting duty.
Cross-Border Transactions
Using a foreign platform does not itself determine the Turkish tax result, and using a Turkish platform does not automatically create or remove a filing duty. Tax residence, the character of the income, domestic law and any relevant double-taxation treaty must be considered together. Treaty relief cannot be inferred merely from the existence of a platform account.
Frequently Asked Questions
Does an exchange automatically deduct 0.03% tax from my sale?
Law No. 7518 does not impose that general deduction. If an amount is deducted, ask the exchange to identify whether it is a contractual fee or a tax and to provide its legal basis.
Is a crypto-to-crypto conversion automatically subject to BSMV?
Law No. 7518 does not impose a 0.03% BSMV charge on every conversion. The treatment of the transaction must be assessed under the applicable rules and facts.
Do I need to file a Turkish tax return?
A licensed-platform account does not settle the question. The answer depends on tax residence, the nature of the activity, any income or business classification and the applicable reporting provisions.
Can losses be offset against gains?
Loss treatment depends on the tax classification and the applicable statutory conditions. It cannot be derived from a supposed 0.03% transaction levy.
